“Mad Dash”

Terms and Conditions

1. The “Promoter” is MERLEHAN BOOKMAKING PTY LTD (ABN: 97 112 695 986). The address is PO Box 455, MIAMI, Qld 4220 Australia (Promoter). The Promoter and its related companies are referred to as the Promoter.

2. Instructions and information on how to enter the promotion form part of these terms and conditions, and entry into the promotion is deemed acceptance of these terms and conditions and all of the Promoter’s terms and conditions.

3. Entry to the promotion is free and open to residents of Queensland who are 18 years of age or older that complete an online entry form via the TopSport MAD DASH landing page and who have a registered account with TopSport.

4. Entry to the promotion is open between the times and dates listed below:

5. Entrants can have only one entry in the promotion for each of the four matches listed.

6. To enter, entrants must enter their details and complete the entry form on the entrant’s own device.

7. Directors, managers, agents, employees of the Promoter and their immediate families are not eligible to win any prizes resulting from this promotion, as are any customers identified by the Promoter as “bonus abusers”.

8. Three winning entries will be drawn by the Promoter for each Promotion Period at the times and date listed in clause 4. The Promoter reserves the right to alter the respective Promotion Periods owing to early or late conclusions of the respective Gold Coast Titans matches.

9. The first two valid entries drawn in each Promotion Period will win the chance to run the Mad Dash for the prizes (Contestants). The Promoter’s decision as to the result of the prize is final and no correspondence will be entered into.

10. The Promoter will attempt to notify each prospective Contestant via telephone and email immediately after the draw times listed in clause 4.

11. If a Contestant is unable to be contacted after within 24 hours of the draw time, then that person’s right to being a Contestant and winning the prize is forfeited and the Promoter will conduct such further draws at the same place as the original draws as are necessary at in order to select a contestant for the competition as determined by us in our absolute discretion, subject to any directions given by a responsible authority under any relevant legislation. In the event that a further draw is required, the Promoter will also attempt to notify the subsequent winning entry via telephone or email.

12. All Contestants will each receive 2 x General Admission tickets. The retail value for this prize is approx. $204 AUD.

13. In the event Contestants do not attend the respective Gold Coast Titans match at the date and time in which they have been drawn to participate, then that person’s right to being a Contestant and winning the prize in clause 14 is forfeited and the Promoter will conduct such further draws as are necessary at the respective Gold Coast Titans match in order to select a Contestant for the competition as determined by us in our absolute discretion, subject to any directions given by a responsible authority under any relevant legislation.

14. At the designated half time break in each match, the Contestants for each Promotion Period will come onto the playing field, and will stand approximately 20m out from the try-line. The Contestants will touch their forehead to a wooden pole and spin around it for approximately 30secs or as directed by the MC and support staff on the day. The Contestants will then run to pick up a football that is on the playing field approximately 10m away from the try-line. Once they have picked up the football, the Contestant must cross the try-line and down the football for a try. The first Contestant who crosses the try-line and grounds the ball successfully will win a bonus bet valued at $500 AUD added to their TopSport betting account.

15. Contestants will individually win a bonus bet valued at $500 AUD for successfully completing and winning the Mad Dash race first. The Promoter’s decision as to who successfully crosses the line for a try first is final.

16. The following conditions apply to the prize:

a. The prize will be deposited into the prize winner’s TopSport betting account as a a bonus bet valued at $500 AUD within fourteen (14) days of the Promoter being provided with their account details;
b. The prize is limited to those outlined in clauses 12 and 14, and any additional costs or charges must be paid by the winner;
c. The prize is limited to persons who are 18 years of age or older;
d. The prize winner must do everything required of them to accept and take delivery of the prize within a reasonable period of time;
e. If the prize winner fails to comply with clause 15(d), their right to the prize will be forfeited and they will not be compensated in any way;
f. If the prize (or a component of it) is not available for any reason, we reserve the right to substitute the prize with another of similar value, or at our discretion, with a cash sum
equivalent to the retail value of that component of the prize;
g. The right to the prize is not transferable or assignable to another person; and

17. The retail value for the prize detailed in clause 14 is up to $704 AUD per Contestant.

18. The Promoter reserves the right, at any time, to verify the validity of any entry or disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. The decision to verify, validate or disqualify an entry is in the Promoter’s absolute discretion.

19. If the Promoter reasonably considers that a change to these terms and conditions is likely to benefit entrants or be immaterial detriment to entrants, then the Promoter can make the change immediately and does not need to notify entrants. Alternatively, the Promoter may vary these terms and conditions by placing a notification at all places where these terms and conditions are made available to entrants.

20. The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter is not responsible for any problems or technical malfunction of any computer system, software or internet difficulties, including any damage to an entrant’s device, resulting from participating in the promotion. Any cost associated with participating in the promotion are the entrant’s responsibility.

21. The Promoter will not be liable for any loss or damage or personal injury suffered or sustained in relation to the promotion or a prize except for any liability which cannot be excluded by law.

22. If the Promoter is prevented from or delayed in performing an obligation by Force Majeure then the obligation is suspended during, but for no longer than, the period the Force Majeure continues and any further period that is reasonable in the circumstances. ‘Force Majeure’ means any event beyond the reasonable control of the Promoter, which occurs without the fault or negligence of the Promoter.

23. Subject to obtaining the approval from the regulator (if applicable), the Promoter reserves the right to delay, modify or cancel (if need be) any aspect of this promotion if for any reason it is not capable or running as planned (including without limitation, by reason of infection by computer virus, bugs, tampering, fraud, technical failures, power failures, inclement weather event or due to any other causes unforeseen or beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion) but only to the extent necessary to overcome the issue that is affecting the running of the promotion as planned. This also includes the Promoter having the right to cancel the promotion in the event that the Promoter, in its sole discretion deems that it is unsafe to carry out any or all of the activities involved in the promotion.

24. By participating in the promotion, an entrant authorises the Promoter, and contractors and agents of the Promoter, to access, collect and use personal information about the entrant, and disclose personal information about the entrant, to the Promoter and its contractors and agents, for the purposes of (i) conducting the promotion and (ii) providing the entrant with information and marketing material about products and services of the Promoter; and (iii) making arrangements for a prize winner to be notified and receive their prize. Such information may be provided electronically, or by contacting the entrant by telephone or other means, until such time as the entrant asks the Promoter not to provide further information. The Promoter’s Privacy Policy (available at https://topsport.com.au/Privacy contains information about how to access, correct or make a complaint about the Promoter’s handling of personal information. A Contestant agrees to the use of their image and participation in any publicity associated with the promotion.

25. If an entrant does not provide the personal information requested, the entrant cannot participate in the promotion and will not receive information about products and services of the Promoter. An entrant can request access to information held about them by contacting the Promoter at support@topsport.com.au

26. All references to time in these terms and conditions are a reference to local Brisbane time, except where otherwise indicated.

27. The Promoter’s general Promotional Terms and Conditions also apply to this promotion.
